In Yekaterinburg, a real war broke out between the residents of the house on Cherepanova Street, 12 and the Verkh-Isetskaya management company, the founders of which are relatives of city and regional officials. The confrontation has lasted more than two years: the residents want to create an HOA because they believe that the management company is illegally extorting money from them for major repairs. The management company denies the accusations and points out that criminal cases have already been brought against the chairman of the house’s board.

“We wanted to control the movement of funds”

On September 26, the Verkh-Isetsky District Court of Yekaterinburg will begin proceedings in a criminal case against Victoria Dubova, chairman of the council of the house on the street. Cherepanova, 12 (Zarechny microdistrict). The case under parts 1 and 3 of Article 327 of the Criminal Code of the Russian Federation (“Forgery and use of a knowingly forged document”) was initiated after the general director of the Verkh-Isetskaya Management Company, Elena Malakhova, wrote a statement to law enforcement agencies with a request to conduct an audit of Dubova’s activities.

As stated in the resolution to initiate a criminal case, Victoria Dubova is accused of producing a fake protocol for an extraordinary general meeting of homeowners (Minutes No. 02), and also, according to investigators, presenting it to the tax office during registration legal entity forged document - protocol No. 04. As Dubova herself explains, we are talking about protocols that were adopted following the results of meetings of residents, at which they decided to refuse the services of the management company and create a partnership of property owners (TSN, in fact, a synonym for HOA).

According to the SPARK database, 25% of the company belongs to Elena Yatskova, the daughter of Yekaterinburg city manager Alexander Yakob, and another 20% to Natalya Godlevskaya, the wife of Sverdlovsk Deputy Prime Minister Alexander Vysokinsky.

Victoria Dubova became the chairman of the house's board in August 2015. However, according to her, Verkh-Isetskaya Management Company did not make contact, and then the residents of the house decided to refuse her services and create a HOA. So far it has not been possible to do this. Now activists are suing the tax office, which refused to issue them permission to register a new legal entity, citing subparagraph 2 of paragraph 2 of Article 136 of the Housing Code. It states that residents should have chosen an authorized representative, which was not done.

Previously, another case was brought against Dubova - under Part 1 of Article 330 of the Criminal Code “Arbitrariness”. The point was that Dubova entered into an agreement with former electrician of the management company Rinat Salmanov, who rented a utility room of the house for 4 thousand rubles per month. “All the money was spent on the needs of the house: a spotlight was purchased to illuminate the dark arch of the house, locks were installed on the electrical panels. I have all the receipts,” Dubova explained. The Criminal Code insisted that she “illegally collected money.” “In addition, Dubova believes that she can arbitrarily cut off the iron partitions on the landings of the entrances,” the press service of the Verkh-Isetskaya Management Company told the site, adding that the actions of the chairman of the House Council “go against housing legislation,” falling, according to them opinion, under the criminal article “Arbitrariness”. However, later the paperwork was terminated, since Victoria Dubova caused minor harm to the owners of the house. Her actions were reclassified under Article 19.1 of the Code of Administrative Offenses of the Russian Federation “Arbitrariness”.

Controversial loan for major repairs

Conflict between residents of a house on the street. Cherepanova, 12 and the management company “Verkh-Isetskaya” began back in 2012. Then a major renovation was carried out in the apartment building: the hot and cold water supply risers were replaced, and the sewage system was repaired. According to the minutes of the general house meeting dated June 25, 2012, the total cost of the work was 11 million 917 thousand 333 rubles. But the balance of the house at that time contained only half of the amount - 5 million 795 thousand 776 rubles. This is money that was accumulated over several years by residents who regularly transferred money for major repairs according to the appropriate column in their monthly receipts. The remaining amount - 6 million 121 thousand 557 rubles, according to the same protocol dated June 25, was provided by the management company to residents in the form of an interest-free loan. They had to repay it by July 1, 2017.

However, as the residents of the house, in particular Victoria Dubova and Kristina Selivanova, say, they know nothing either about the meeting at which the minutes were allegedly drawn up, or about the loan that they must repay. They claim that representatives of the management company promised them that the missing 6.1 million rubles would be paid from the federal budget, since the house on Cherepanova, 12 was included in the federal overhaul program. However, the promises were not documented, and the Verkh-Isetskaya Management Company explained that “the management company did not promise to pull money out of thin air.”

Since April 2014, a new column has appeared in receipts - “Reimbursement of costs for major repairs.” Residents were asked to pay 10 thousand rubles additionally to repay the management company’s loan.

The Verkh-Isetskaya Management Company website explained that a separate column for loan repayment was allocated, since the system for carrying out major repairs has changed since 2014. If the house does not create its own special account, the money goes into the “common pot”, which, in accordance with the regional program, is managed by the regional capital repair fund. Thus, the management company offered residents to pay separately for major repairs to the fund and separately to repay the loan to the management company.

Activists of the building tried to challenge the terms of the loan, and in early August 2015, the Verkh-Isetsky District Court of Yekaterinburg declared the minutes of the residents’ meeting dated June 25, 2012 invalid. The Criminal Code tried to appeal the decision in the regional court, but it remained unchanged. There are no other documents concluded between the residents and the management company related to the provision of money in debt.

However, the management company did not return money to residents who had already begun to repay the debt, and continues to charge penalties to residents who do not repay the loan. The Criminal Code explained to the site that “the court’s decision does not affect the issues of returning funds to the owners, it concerns only the protocol itself.” “Verkh-Isetskaya” insists that “the invalidation of the protocol means that every owner of the house has unjustifiably enriched himself and is obliged to reimburse the management company for the costs spent on major repairs.”

From Kristina Selivanova, who lives on Cherepanova, the Criminal Code even tried to recover about 19 thousand rubles through the court. The girl stated that she was not going to repay the loan, which she knew nothing about. The Verkh-Isetsky District Court ultimately sided with Selivanova, citing, among other things, the court’s decision to invalidate the protocol of June 25, 2012.

The confrontation continues

Now the confrontation between the activist at home and the Criminal Code continues. Leaflets periodically appear on the territory of the house, saying that Dubova is a “swindler” who “single-handedly wants to take possession of the money from the house.” Some leaflets have intimate content: a photograph of Dubova is attached to the image of the girl’s naked body. The activist contacted the police, and, according to her, it turned out that these leaflets were distributed by the security service of the Verkh-Isetskaya Management Company.

In turn, representatives of the management company deny their involvement in the distribution of leaflets and emphasize that at the moment house on the street Cherepanova, 12 is legally managed by the Verkh-Isetskaya Management Company.

“The debt of the residents of the house on Cherepanova, 12 for housing and communal services currently amounts to more than 6 million rubles. At the same time, the debt to reimburse repair costs is less than 160 thousand rubles. At the moment, no new charges are being made under the item “reimbursement of costs for repairs of common property,” the management company explained.

In addition, the management company insists that the residents’ meeting in April 2016, main theme which was the creation of the HOA, was carried out in violation of the law. Firstly, according to the law, homeowners had to be notified of the meeting no later than 10 days before the date of its holding. This was not done, the Criminal Code claims. “Secondly, the dates for the meeting were set from April 9, 2016 to April 30, 2016, but, according to the residents, the decision forms (ballots) were signed before the start of the in-person meeting, that is, before April 9, 2016, and also after April 30 2016,” the Criminal Code reported. Thirdly, many owners withdrew their decisions during the voting process because, in their opinion, they were misled. “The initiator Dubova did not return a single decision to the residents. The Federal Tax Service of Russia for the Verkh-Isetsky district refused state registration of this partnership of real estate owners,” the Criminal Code noted, emphasizing that criminal cases have been initiated against Dubova.

The court will apparently put an end to the conflict between the residents and the management company.

Residents of houses managed by the Verkh-Isetskaya Management Company switched to information and settlement services in the Unified Center. Owners and tenants of residential premises will receive the first receipt in early September - with accruals for August.

Due to the technical features of the transition to a new software for settlements, payments made since July 26 are not currently reflected in the personal account of the management company. In this case, all payments are taken into account - and will be indicated on the next receipt.
